The case has been underway for a year and relates to a deal between Atletico and Chelsea when the London team bought him in 2014.
Costa has been in trouble many times on the pitch over the years and now being implicated in similar tax issues to those which has plagued numerous Spanish based sports stars.
Over the years, Messi and Christiano Ronaldo has been involved in similar issues of tax fraud.
If Costa is found guilty and charged, it is likely to end in the usual find fee paying.
